Dear Prospective Client:
Please read the Bankruptcy Information Brochure that is attached. It provides important information about bankruptcy cases.
To get started on a bankruptcy, print and complete the information in the document entitled Debt Listing Sheet and Current Income and Current Expenditures statement. If you want to proceed with commencement of a bankruptcy action, please list the complete name and full address of all creditors to whom you owe a debt. Please be sure to include the full address for each creditor, including the zip code. For each creditor listed, please include all of the information required on the Debt Listing Sheet, especially in column two which asks you to list any collateral pledged to the creditor for the debt. Most of the information required by the Debt Listing Sheet may be found on the latest billing statement you received from the creditor.
Please be sure to include the complete name and address of every business and person to whom you owe a debt. Failure to include any debt on the Debt Listing Sheet will preclude my office from including the debt in the bankruptcy proceedings. Include as a creditor anyone or any business that claims that you owe a debt, even if you dispute owing the debt or the amount claimed.
The Current Income and Current Expenditures statement is part of the documents that will eventually be filed with the bankruptcy court. The information that you supply in the statement assists my office to determine the type of bankruptcy proceeding that will be most beneficial for you.
The Property List must set forth all your property in order to protect your property from your creditors and the bankruptcy court. Failure to list your interest in any property will prevent me from considering it and may result in losing the property.
In order to employ my services to represent you in commencing a bankruptcy action, you must do the following:
- Complete and return the Debt Listing Sheet.
- Complete and return the Current Income and Current Expenditure statement.
- Complete and return the Property List.
Once I have received and reviewed the above items, I will forward to you an original and one copy of another document entitled “Engagement Agreement” which sets forth the terms and conditions under which I am willing to represent you in commencing a bankruptcy proceeding. In order to employ my services to represent you in commencing a bankruptcy action, you must return this document once you have reviewed and signed it and you must pay the retainer fee and filing fee.
Until I receive the executed Engagement Agreement, retainer fee and filing fee, please be reminded that my office is not representing you and is not protecting your interests.
